SCULPTpdx (“Sculpt”, “we”, “us”, or “our”) is committed to protecting your Personal Information (PI) in a responsible and secure way. 

This Privacy Policy will cover how we collect, use, and/or disclose the information we obtain about visitors to our mobile application (app), our website (www.sculptpdx.com) (site), and our SCULPTpdx studios. By utilizing any of these services and providing us with your PI, you acknowledge that said PI will be handled as described in this Policy. 

Please read our Terms of Service before accessing or engaging in any Services provided by Sculpt. To the extent permitted under the applicable law, by accepting the Terms of Service, you agree with our privacy practices as described in this Policy. If you can not agree to this Policy, or Terms of Service, or other policies provided by Sculpt, please do not access or use our Services. 

This policy may be modified at any time and changes may apply to any PI we currently hold about you, as well as information collected after the medication of the policy. The modification date at the top of this policy will be notice of the last revision. Continued use of Sculpt Services will serve as acknowledgment and acceptance of the updated Policy. 

THE INFORMATION WE COLLECT ABOUT YOU

Information about you may be collected directly from you and from other parties. The information we collect from you depends on how you use our Site, App, and Services. 

Account Information. Information you provide about yourself to access our Services. This will include your name, email address, phone number, and mailing address, so that we may communicate with you and provide you with the Sculpt experience through our services. 

Scheduling Information. In order to sign up for a Sculpt class or purchase Class Packs or a membership online, you must provide us with your name, physical address, email address, date of birth (DOB), phone number, and payment information. 

Health Conditions. If you make a purchase or sign up for a class, you may be asked to include information about health conditions that could affect your ability to participate in a workout. This may be necessary for the Sculpt coaching staff in order to provide a safe and effective workout for you. If you do not provide this information, you may not be able to participate in a Sculpt class or event. 

Payment Information. When making a purchase through our Services (Membership, Class Packs, merchandise), Sculpt will need to collect payment information. A payment card must be provided to us, which will include credit card number, expiration date, security code; we may also need to collect billing information such as billing address, phone number, and the name on the payment card. There will be a third-party merchant service company that will store and process this information securely and will only use it for the purpose of a purchase through our services. 

Voluntary Information. Information you provide to us voluntarily by completing web forms, surveys, job application, polls, instagram, blogs, posting, verbal communication with customer service, or any other means of communication. 

Membership and Studio Information. We will collect PI about how you interact with Sculpt studios, social media platforms, booking time, check in times, workouts, and class schedule. 

Information from Our Studio. We have CCTV installed in and outside of our studio to monitor security and safety of our staff and members, this also assists in crime prevention. We may collect PI about you through our CCTV systems, including your image or likeness. 

Information from Third Party Applications of Platforms. Sculpt may work with third party companies for integration for marketing, booking classes, or other services. 

Job Application Information. If you apply for a job posting, we will collect information necessary to process your application or to retain you as an employee, which may include education, job history, experience, certifications and licenses and more. This information is required for us to consider employment. 

Social Media. Sculpt may be part of many social media platforms. Anything posted on a platform may be used to collect data. Information may be collected when you message us, tag us, or interact with us on a social media platform. Information may also be collected from posts, comments, polls, and followers on social media platforms. Basic information may be taken from social media platforms such as name, profile picture, gender, networks, user ID’s , list of friends, DOB, email address, phone number, and any other information you have purposely or accidentally made available on this platform. 

InBody Scanning Machine. In the Studio we have the InBody scanning machine which will measure your body’s muscle mass, fat percentage, total body water, visceral fat, and your overall body composition and body mass index (based on your height, weight, gender, and age). These scans help understand the effects of your workouts.

Heart Rate Monitors. Throughout your workouts in the Studio, Sculpt has made it possible to track and display your heart rate on the monitor. Other information collected may be calories burned and max heart rate. Sculpt has the ability to track this information. This information can be used to increase the effectiveness of your workout. 

HOW WE USE YOUR INFORMATION

Throughout the many mechanisms of collecting PI, Sculpt will only use the collected information for the following purposes:

To Provide Our Services. At those most basic level, Sculpt will use the collected information to provide you with our Services at an advanced level. Some examples of how your PI may be used include, but are not limited to: 

– To allow you to view, book/reserve, and attend classes at our studio

– To pay for services

– To ensure a safe work-out environment

– To analyze your use and enjoyment of the Services

We could not provide you with the same level of Services without using the collected information. 

To Communicate With You. Communication is key for us to continue to develop a relationship with our members. We may use email, phone numbers, or social media to connect with you. Connections may be regarding class bookings, newsletters, promotions, discounts, billing information, satisfaction surveys, questions, photos/videos, support, policy changes, or other information that we think may interest you to further build a lasting relationship. 

Marketing Communication. We may also utilize your PI for marketing initiatives. This may involve special promotions or incentives that will be communicated to you. 

To Enforce our Terms of Services and Policies. To maintain and safe and secure work out environment, we may use your PI to ensure that all policies are being followed and enforced. 

Research and Development. We want to continue to improve our services so that we can continue to meet your needs and exceed your expectations. Some of your PI may used to optimize or expand services, such as class times, trends, polls, InBody tracking, and heart rate systems. 

To Comply with Applicable Laws. We may be necessary to provide information to law enforcement agencies or other agencies if required by the law, or in good faith belief that such preservation or disclosure be reasonably necessary to comply with legal authority, enforce Sculpt’s Terms of Service and other policies, violate the right of other members or property, or to provide personal or professional safety to Sculpt’s members, staff, and facility. 

For Employment. When receiving applications for positions at Sculpt, the information will be used to see if you are a good and appropriate candidate for the open position. Information may be collected and saved for potential or current employment. 

How We Share Your Information

 We may share your information for the reasons listed:

Workout Sessions and Challenges. Participants in the workout may have their name shared on the screen, with their heart rate, calories burned, and max heart rate. Such information may be posted on the social media accounts. There will also be videos and photos taken during and after workout sessions that may be posted on accounts. If you are participating in a challenge, your name and results may be posted online. 

Health-Focused Apps. When utilizing the heart rate information collected during your workout, unaffiliated health-focused apps or operating systems may have access to collected data. 

Third-Party Service Providers. Outside providers may work with us to perform certain duties or Services. These providers may process or store data, track or analyze services, assist in marketing, advertising, videography, photography, or customer support. These third-party services will have their own Privacy Policies. 

Legal Obligations. We may share your PI if it is reasonably or legally necessary to comply with a legal process or investigation. 

YOU ARE IN CONTROL

Your Account. You have the ability to edit personal information when you access the your account through the Sculpt App or Site. You can edit information such as email address, phone number, home address, name, DOB, and billing information. It is important to note that old information may be stored in order to prevent fraud or other violations of terms. However, if you do not provide us with some of this PI, we may not be able to provide you with access to our services.

Voluntary Information. We will often times send out information, surveys, polls, or other forms of communication that you have the option to respond to. These will not be mandatory to have access to our services. 

Communication Preferences. You will have the option to opt out or unsubscribe from messaging from us. We still hold the right to reach out for direct communication with you regarding billing or a communication that we believe may be of interest personally to you. 

Account Deletion. At any time you can delete the App and no longer update or provide us with your information. However, deleting the App does not delete your account or personal information. If you would like us to delete as much PI as we can, please email us at info@sculptpdx.com with you request. This does not guarantee that we can remove some PI, as it is subject to limitations, in order to maintain a legal history and meet retention requirements. 

Cookie Preferences. You can exercise your preference in relation to cookies that are utilized on your web browser. 

THIRD-PARTY SERVICES

When using any third-party system in affiliation with Sculpt or not, we are not responsible for their Privacy Policy or Terms of Services. It is required for you to do your due diligence when accessing these sites, as we encourage you to be read their policies and statements. 

SECURITY

No system can be 100% secure, however, at Sculpt we take security seriously. All billing information will be held with a third-party merchant service provider, which will make it inaccessible to all staff and members. We will use certified companies to build out our App, Site, and Email, in order to avoid your PI from being compromised. We encourage you to create your account information by keeping your password confidential. If you are aware of concerned with a security breach please email us at info@sculptpdx.com. 

PRIVACY FOR CHILDREN

By using our services, you are stating that you are the age of 12 or greater and allow us consent to collect information. If we discover that the user is under the age of 12 we will delete such information of the user. Please contact us at info@sculptpdx.com if you believe that a child without consent is using our services. 

RETENTION

We will retain all information of your PI until requested to delete unnecessary information from our system, but it will be deleted at our discretion. You cannot request to delete information for any other user other than a minor, if you are the responsible guardian.
